Apple Says Only A Moron Would Take Apple's iPhone Ads Literally

Apple responded to claims recently responded to claims that their TV ads for the iPhone 3G are deceptive in nature. The lawsuit claims that Apple's touting of the iPhone 3G as "twice as fast for half the price" was incorrect and misleading. Apple starts off by saying that the statements made in their ads "were truthful and accurate and were not misleading or deceptive." Most interesting, however, was their claim that, to paraphrase, only a fool would believe those claims.

"Plaintiff's claims, and those of the purported class, are barred by the fact that the alleged deceptive statements were such that no reasonable person in Plaintiff's position could have reasonably relied on or misunderstood Apple's statements as claims of fact," Apple's attorneys wrote.

And they're right.

Say, let's everybody start a class action lawsuit against Tide, their commercials show they get stains out in 5 seconds flat, and it just doesn't happen. Fraud!

Hmm, that *is* paraphrasing...badly.

They said nothing about anyone being foolish. It would be more accurate to report that only an unreasonable person would take their ads literally. (E.g. someone who intentionally argues that reality doesn't match what is shown in an advert a few seconds long.)

Twittelator & Emocon's

Its common knowledge that the 2.2 release enabled the use of Emocon's; most assumed only in Japan on the Softbank Network where they are very popular with the texting set. Heads up, I downloaded and began using Twittelator just yesterday and low and behold, it has working Emocon's and they work here in the US on the AT&T Network on my 3G! This is not the case on regular or premium versions of Twitter, no Emocon availability.
