...I've been under the impression that the phone will have to be sent back to Apple to replace the battery; does anyone know what's gonna happen when they get ahold of hacked phones? I'm pretty sure the mods can be reinstalled, etc. but has anyone thought this through?

Do a system restore. But I'm pretty sure they check to see if you activated a plan with an official carrier or else they void your warranty.

I'm assuming this is all for hypothetical purposes and that you're not actually experiencing this problem. Because if ever a hacked iphone's battery dies (if it ever does) I'm sure the free one-year warranty will be long over (haha and I'm sure no one who hacked the phone bought applecare). So I think then it doesn't matter if its hacked or not because you'll still have to pay the set warranty-less price.

Yeah it's hypothetical, but eventually the batteries will all need to be replaced, right? I thought I read that the battery life has a limit and then will need replacement in something like 2 years. And when they do, I was just wondering what will happen....I would think most of them will be coming in to Apple service centers over a fairly defined period of time--seems like it would be a lot to have to check each individual phone to see if it had been activated ever.
As for me, my phone's activated. I stupidly got one early, activated, then put it in the box for awhile as I had issues with the email and keyboard. Used Blackberry (and still do) but now having issues with syncing, random mail wipes, keyboard, and buggy EDGE/WiFi connections....so I've rethought the iPhone and it's sync-ability, the mod factor (which I committed to making myself follow through and learn to do, etc.).
Sorry, TMI. I know.

You are correct. The original estimates were from 300 to 400 complete battery cycles. A cycle is a complete discharge and charge. If you use only 25% of your battery each day and charge your phone each night, it will take you 4 days to use up one of your 300-400 cycles. It seems to me that I read the fee to replace the battery was $69 too. That included shipping.
Since this is a hypothetical discussion, if you bought your phone on day 1, you only have tomorrow worth of warranty left. So, you better get in to your Apple store quick! In fact, I was in my Apple store yesterday to get a foot replaced on my MacBook Pro and during the 40 or so minutes I waited for my Genius appointment and service, I saw no less than 5 iPhone replacements! The technicians were not even giving it much thought. They were casually looking over the customer's iPhone and pulling a "new" one out of a plain white box as a replacement. I thought about whipping out my phone and complaining about battery issues but I had all my unauthorized apps on it

There are also DIY battery replacement kits out there. its pretty tricky to take the back off without bending it so sending it in would be 1st priority.
But in all reality, I think that when a battery dies on a first gen iPhone, there will be atleast 2-3 gen's preceding the phone. Better off just upgrading.

There are also DIY battery replacement kits out there. its pretty tricky to take the back off without bending it so sending it in would be 1st priority.
But you might think about one of those replacements to get a bigger batterie so it allows you to use your phone for two days or even more.

I have a first gen iphone, I charged it last night and this morning it is almost dead. This is the first time this has happened to me, could this be the 2.0 firmware, or the additional apps, that drained the battery overnight. :(

Did you turn off your computer and leave the iPhone still hooked up?

no computer was on, removed iphone at about 6:30, got to work, checked phone when it beeped at me about 10:30, it had red lined.
